What VinCount is
VinCount is a data service for used-car dealers. It shows car listings that sellers posted publicly on Craigslist, Facebook Marketplace and OfferUp, with what VinCount saw on each one. It covers the markets named on the site, and Los Angeles is the only one today.
In these terms, "VinCount", "we" and "us" mean the operator of vincount.com. "You" means the person using VinCount and the business they use it for. You must be 18 or older and use VinCount for a business.
VinCount is in alpha
We are building VinCount while dealers use it. We provide it as is. Features, columns, markets and data may change or stop without notice, and the data can have gaps and errors. We may change, pause or end the service, or any part of it, at any time.
Accounts
A subscription covers one dealership in one market. Each person at your dealership who uses VinCount signs in with their own account. Do not share VinCount with anyone outside your dealership. You are responsible for what happens under your account. If you think someone else has used it, tell us at hello@vincount.com.
Subscription and billing
Prices are per market, per month, in US dollars. A subscription runs month to month. You pay for each month in advance, on the day it starts, through our payment processor.
You can cancel any time. Canceling stops the next charge, and you keep access until the end of the month you paid for. We do not refund partial months. If a payment fails, we may pause your access until it goes through.
Early-bird price and price changes
If you join at the early-bird price, you keep that price as long as your subscription stays active without a break. If your subscription ends and you subscribe again later, you pay the price in effect then.
For any other change to what you pay, we email you at least 30 days before it applies. If you do not want to pay the new price, cancel before it takes effect.
How you may use VinCount
You may use VinCount to find cars for your own business to buy. You agree that you will not:
- resell or republish VinCount's data, or give copies of it to anyone else
- copy VinCount's pages or data with scripts or other automated tools, or get around any limit on access
- contact a seller in any way the law does not allow, including under telemarketing and text-message laws
- use a seller's contact details for anything other than asking about the car they advertised
- break the rules of Craigslist, Facebook Marketplace or OfferUp when you use those sites to reach a seller or buy a car
- use VinCount to harass or track anyone, or to break any law
You are responsible for every call, text and message you send to a seller. If you break these rules, we may suspend or end your account without a refund.
The data
The listings come from ads that sellers wrote. Anything a seller states, such as mileage, title status, condition or VIN, is what the ad says. We do not verify it. What VinCount reads from an ad or its photos, such as a license plate, a tag for what the ad says or a "likely dealer" mark, can be wrong. Figures VinCount shows from other sources, such as auction or retail prices once they are added, come from those sources, and we pass them on without checking them.
VinCount does not value cars, score deals or advise you on what to buy. You decide which cars to buy and what to pay. Inspect a car and check its title and history yourself before you pay for it. A listing may be sold, changed or gone by the time you see it.
The listing sites
VinCount is not affiliated with, endorsed by or sponsored by Craigslist, Meta or OfferUp. Their names and marks belong to their owners. Their sites have their own terms, and those terms apply when you use them.
What we own
We keep all rights in VinCount, its software and its design. Your subscription gives you a personal right to use VinCount for your business while the subscription is active. You cannot transfer that right.
Disclaimers
VinCount is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the service will run without interruption or error, that the data is complete or correct, or that any car is still for sale.
Limit on our liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if we were told they were possible. We are not liable for any car you buy or do not buy, or for anything a seller says or does.
Our total liability for all claims about VinCount is limited to the fees you paid us in the 3 months before the event that led to the claim. Some places do not allow these limits, and there they apply only as far as the law allows.
Your responsibility for your use
You will defend VinCount against any claim that comes from your use of VinCount, and pay the damages, settlements and reasonable legal fees that result. That includes claims about how you contacted a seller, the cars you bought or sold, and any breach of these terms or the law by you or anyone using your account.
Ending your use
You can cancel as described above. We may suspend or end your access if you break these terms. The sections on the data, disclaimers, our liability, your responsibility and the governing law still apply after your subscription ends.
Governing law and courts
California law governs these terms, without regard to its conflict of laws rules. Any dispute about VinCount or these terms goes to the state or federal courts in Los Angeles County, California, and you and VinCount agree to those courts' jurisdiction.
Changes to these terms
We may update these terms. We post the new version here with a new date at the top, and we email subscribers before a change takes effect. If you use VinCount after a change takes effect, you accept the new terms.
If a court finds part of these terms unenforceable, the rest still applies. If we do not enforce a term, we have not given it up.
